This is totally stupid, mega pathetic. A 2 time sex offender whom is nameless gets probation for having sex with a 13 year old.

Paying a 13-year-old to have sex didn't warrant time behind bars for a city man, Alberta's top court ruled yesterday.

A three-member Alberta Court of Appeal panel agreed with defence lawyer Alias Sanders the conditional sentence handed her client was justified.

The court upheld the Jan. 18 decision of provincial court Judge Heather Lamoureux to sentence the twice-convicted sex offender to a two-year community term.

The Crown challenged the decision, saying jail was needed, but the appeal judges disagreed.

"We are not persuaded that the sentence is demonstrably unfit, or that the sentencing judge erred in principle," they said in a written ruling.

The court said Lamoureux carefully considered the behaviour of the offender, who was not named because he has a youth conviction for molesting his sister.

The man, then 21, offered a 13-year-old girl he'd met on a bus money to perform a sexual act on him.


The June 27, 2003, incident came to light two days later when the girl's foster mom asked her where she got the $75 he paid her.

"While the (offender) offered his victim money for sexual services, his conduct was not coercive," the appeal court said.

"There was no intercourse, no physical control, no pattern of abuse against the same victim, no use of alcohol or drugs to have his way with the girl and no videotape.

"This case involved an immature young man having sexual relations with a willing underage girl, whose consent was unlawful and not in itself mitigative of the offence," the judges said.

Now look at it this way. What is the creep at home reading that story thinking as he is downloading kiddie porn?

Oh gee, if I offer money and they say yes then the system thinks it is no big deal.

Thanks to Bill Clinton, oral sex is not considered sex anymore and the courts seem to buy into that.

P.S. I thought Harper was more of a law and order guy! Seems like he is just like Chretien, he says all the right things but does nothing about it. Boo! I guess the lawyer association and judges must be powerful.

Recently near Dallas, NBC had that show called 'To Catch A Predator' and made quite a few busts.

One person who was caught trying to have sex with a 13 year old boy was a Distrcit Attorney. As soon as the police and NBC showed up to arrest him, he commited suicide.

The local judge or assistant DA decided to drop all charges to the 25 or so people who were busted. And on top of that, many of the legal eagles are angry that NBC would be so mean as humiliate these creeps to the point they commit suicide.

Gee whiz, do they want these creeps busted or free to commit more crimes?

ROCKVILLE, Md. ?  Charges against a man accused of repeatedly raping and molesting a 7-year-old girl were dismissed last week because the court could not find an interpreter fluent in the suspect's native West African language.

Mahamu Kanneh, a Liberian native who received asylum in this country and attended high school and community college here, according to The Washington Post, was denied a speedy trial after three years awaiting a court-appointed interpreter who could speak the tribal language of Vai.

A court-ordered psychiatrist determined that Kanneh, despite his functional facility with English ? he originally spoke with detectives in English, The Post reports, needed to have Vai spoken in order to understand the proceedings against him.

Loretta Knight, a clerk with the court system in Montgomery County, Md., said she had been unable to find an interpreter to stay on the case, even after an exhaustive search that included the Liberian Embassy and courts in 47 states.

Judge Katherine Savage called her decision to dismiss the charges one of the most difficult she's had to make in a long time, especially since she was aware of "the gravity of this case and the community's concern about offenses of this type."

Prosecutors can't refile the charges but are considering whether to appeal the judge's ruling for the dismissal.

FOX News spoke with a man who claimed to be Kanneh in a five-minute phone conversation on Sunday in English. He said the allegations against him were false and the dismissal of the charges was "a good thing." Asked if the accusations were true, he responded, "I said what I had to say" and hung up.

The Washington Post wrote in its article that in just one night reporters were independently able to identify three Vai translators available to assist in the case. It noted that the need for interpreters has risen starkly in Montgomery County, Md., with the court system spending $1 million in interpreters in 2006, or 10 times the amount it spent in 2000.

According to witnesses who originally reported the case to authorities, Kanneh allegedly repeatedly raped and sexually molested the girl, a relative. In a statement made by the girl to police, she said she had been told she'd be forced to stay in the apartment unless she had sex with Kanneh.

I am confused about that age of consent thing. I see in the states that people can be charged for humping 15 year olds but not 17.

Does this mean a 35 year old man can hump someone as young as 14???????

I agree, those should be charged as pedophiles.

Now that is dead wrong. I don't care how 'mature' a child is, there is never an excuse for an adult to be having sex with children.

I agree with CL, 16 at least should be the age of consent. Man that is disturbing.

Wasn't there a huge debate on this in parliment a while ago? Harper wanted 16, the Liberals wanted it lowered or something like that? I am not sure what happened but I remember some MP saying 'Kids are much more aware of themselves sexualy' as an excuse for it.

What is the motive to allow adults to have sex with kids? It makes no sense at all?

I'm writing Harper and Layton about this right away. Don't write the Liberals anything, if you do, you can expect a phone call asking for donations to the party. THe NDP and COnservatives will just mail you something back but have a history of at least responding to the inquiry.

Yeah i have read many times in history books where during wars especially, younger girls would marry older guys because Dad died at war and mom could barely take care of the kids etc.

Back in those days, those social norms were either for religoius porposes or because they were getting married.

Now people just want to revert back to that so adults can have sex with kids.

I was talking about this on the AMW forum once. There was a guy who is pro pedophile. He really thinks kids are mature enough for sex and the only damage they suffer is that shame brought on them by society condeming that action.

BS. If we accept a person cannot vote or drink at 18, cannot consent to non essential sugery before 18, how can they say it is OK for young kids to have sex????   

I have a 2 steps forward, 1 step backwards theory on our society, this certainly falls in that category.

A pervert who propositioned a five-year-old girl he was babysitting will serve his time on weekends because he's not the brightest bulb and would be in danger in jail.

Jeffery Branden, 38, was yesterday handed a 90-day intermittent sentence and put on probation for two years after earlier pleading guilty to invitation to sexual touching.

Provincial court Judge Michael Allen told Branden he was considering jailing him for six months, but changed his mind after hearing from his defence lawyer.

Tim Stonhouse told Allen his client "is not the smartest individual" and said Branden would not be safe in jail.

"This is a person of limited intellect," said Stonhouse, adding Branden also suffered a brain injury after being beaten up about five years ago.

According to agreed facts, Branden was babysitting the girl and her two-year-old brother on June 24 while their parents, whom he was friends with, ran some errands.

After the girl got dirty playing with sidewalk chalk, Branden told her to have a shower. While she was doing that, he came into the bathroom and began masturbating.

He then told her he loved her and asked if she wanted to touch his penis. The girl hid behind the shower curtain and Branden left after telling her to "keep it a secret."

Luckily, she told her mother and police were called.

Yesterday, Branden told the judge the incident has been "devastating" for him and said he was "more sorry than I've ever been in my whole life."

Allen also ordered Branden to provide a sample of his DNA for the national DNA databank and to be placed on the national sex offender registry for 10 years.

Hi Everyone!!

Remember I told ya's that I was at college, with a gal who did phone sex? She spoke to me about it, and said, she quit after 6 months, because some men would call, and expect her to talk like a 4,5 year old, and call them Daddy.

She refused, and was either fired, or quit. She was a beautiful young lady.

What guy in his right mind would want that? And if he has kids, is he doing something to them? UGH!!!

Former Olympic champion Myriam B?dard was given a conditional discharge and two years' probation on Tuesday for violating a child custody order involving her daughter.

B?dard, 37, wanted to avoid a criminal record so that she could continue to travel around the world and earn a living, she told a Quebec Superior Court at her sentencing hearing in Quebec City.

The former Olympic champion explained that, as a volunteer member of the International Biathlon Committee, she is working on anti-doping policies, which requires her to travel outside Canada.

B?dard also said she is taking part in efforts to create an Olympic biathlon team in India.

She said she'd like to continue travelling with her daughter, who is now 12.

The two-time gold medallist was found guilty on one count of child abduction after she violated a custody agreement.

OK, just a month after a guy murdered a woman at an LRT station, who was out on no cash bail for violence, another Calgary judges lets an accused murderer out on no cash bail.

The suspect in a murder outside a karaoke bar, who allegedly kept a cache of firearms and other weapons at his home, has been released on bail.

Justice Beth Hughes today granted defence lawyer Alan Fay?s bid to have Lee Wesley Hollinger released pending trial.

Hughes said Hollinger could be freed on a non-cash bail of $100,000, posted as a surety by his father.

She also imposed stringent conditions on the city man, including that he possess no knives, except those used in the kitchen, or at work, and no firearms.

There was a publication ban imposed on submissions made by Fay and Crown prosecutor John Szekeres and Hughes? reasons for granting bail at the request of the defence lawyer.


 

Among the other conditions Hollinger must abide by is that he have no contact with any witnesses in the case and he stay away from Ducky?s Pub in the city?s Mission district.

Hollinger, 36, must also abstain from consuming drugs or alcohol, live where approved and submit to random searches of his person and home, Hughes ruled.

It's bad enough that violent criminals even get paroled at all once they have served time, but now they are just left in society to commit more crimes before they EVER serve time? I'm surprised that the judge was a women too.I thought women were more sensitive to these issues especially when it was another woman that he murdered.It looks like the system just gets stupider and more lax every year.I have realized more than ever since coming to this site what a target women are.I think most women feel a common bond with other women no matter what the differences in their lives are.Shame on this judge!

Sometimes I think that just being female in this country is a risk. Gals have been killed going to make a phone call, or going to corner store fro bread and smokes, walking down the street, hitch hiking, a biggie, STW, leaving a bar alone, or leaving with somone you don't know, but feel you trust.

Plus, with all the slayings happening all over, I think some gals are familiaar to the guy(s), maybe thru STW, Crack, drugs of any nature, and psychoe's who come across as friendly.Dealers who sell the drugs, have gotten in with the street crowd, maybe a guy with a badge, fake or nott. Also some women have not ties to any drugs, or hitch hiking, or STW.

That there are more than a few smaller groups, all f'cked up., with a leader they followw. Remember, he has the drugs. Someone told me, and PLEASE jump in if this is wrong!! :) :-[

When a person is using crack, for a while, is addicted, start to think of awful eveil stuff they would never think of doing, if they were straight. The power of

Like the killings that have cropped up in the past 2 years or so, of men killed. I think they saw something, were deemed a risk, or were made to watch somthing, that made them think of their own mortality. They may have become dangerous, to the killers, and they are afraid, they will talk. Coersion is often used to enter a gang.

One of the Bills the Senate is holding up right now would make it harder for violent criminals to get no cash bail. GOod thing, it sends to wrong message and puts people at risk.

Adrian, I know it seems we live in a dangerous world and in a sense we do. Don't live in fear, trust yourself, you have strong intuition, it is there to help you. Know when to run.
