Plea bargain deal for man accused of murdering Okanagan teenager

There will not be a second trial for a man previously convicted of first-degree murder in the death of an Okanagan teenager.

In April 2014, Matthew Stephen Foerster was found guilty in the October 2011 slaying of Taylor Van Diest.

The 18-year-old was was walking along railway tracks in Armstrong when she was savagely attacked.

Van Diest was strangled with a shoestring and then murdered by repeated blows to the back of her head with a heavy flashlight.

Foerster appealed his conviction, and because of mistakes by the trial judge in his final instructions to the jury, Foerster was granted a new trial.

That was scheduled to begin May 28th in Kelowna. Now, a new court date has been set for March 12th when court registry documents reveal Foerster intends to plead guilty.

Taylor Van Diest’s mother says in a plea bargain deal between prosecution and defence lawyers, Foerster will admit to second-degree murder.

“Of course we’re not happy,” says Marie Van Diest. “Just the idea of second-degree on the table is beyond comprehension to us because we know full well what he did. Justice is flawed.”

Van Diest says she’s been told when Foerster is sentenced in April the plea bargain calls for parole ineligibility to be set at no less than 17 years.

Forester’s original sentence for first-degree murder was a minimum 25 years behind bars.

Forester is a serial perpetrator of crimes against women.  His crimes escalated to murder....His last Victim was young Taylor.
We should not be hearing his name anymore...he should be locked away, with no more court dates.
Who is paying for his lawyer anyways?
I always want to know where these killers get their money to pay for lawyers for years and years.

He should never see the light of day, again....he is a dangerous offender.  Out in 17 years is too soon..At least leave it at the original sentence...minimum 25 years behind bars.
I’m sorry Taylor’s loved ones have had to go through what I call a mockery of the system.
Taylor was murdered in 2011.... it is now 2018... her loved ones should not still have to be dealing with the courts....talk about re-victimizing.

At his first trial, Foerster admitted he was responsible for the injuries to Van Diest, but contended he was only guilty of manslaughter or second-degree murder.

His father, Stephen Foerster, was previously sentenced to three years in jail after pleading guilty to helping his son Matthew evade police.

Marie Van Diest said the family is grateful "no one has to go through the torment and torture of a new trial."

"I'm kind of relieved that it's ending here. All we can do is hope for the best and that [the judge] gives him an adequate sentence for what he's done."

Matthew Forester is expected to be sentenced in April.

Taylor’s mom is correct...no one has to go through the torture and torment of another trial...it’s been seven years since they lost their daughter...I can’t imagine their pain.
This crime so disturbs me.....a serial predator hanging around in the dark, in wait for his victim....and Taylor was only out having fun like any teenager on Halloween.
He needs to be deemed a dangerous offender....his Dad is no better.
