CL  this is almost unbelieveable that he would state he wasn't concerned about her state enough to call for help, what  is happening to the people of the world??

Doc says sex attack not sleepwalking

Email Story Print Size A A A Report Typo CALGARY - It's unlikely a Calgary man was asleep when he beat and sexually assaulted a $1,000-a-night hooker, an expert testified Wednesday.

Dr. Patrick Hanly, director of the Foothills Medical Centre sleep centre, said the evidence would suggest Gary Gordon Yuen, 47, was awake when he committed the attack.

Hanly was called by Crown prosecutors Pam McCluskey and Susan Pepper to dispute defence testimony Yuen may have been acting out a dream when he assaulted his victim.

The expert witness said he didn't believe Yuen was in a parasomniac state -- one in which he was committing an "undesirable" act while sleeping -- at the time of the assault in his home.

"The question I was asked was whether the events that occurred on Feb. 11, 2007, could be due to or explained by a sleep disorder," Hanly said.

"My opinion was it was unlikely that the physical and sexual assault was due to a parasomnia."

Hanly said Yuen's interactions with the complainant would suggest he wasn't acting out a dream and was in a state of wakefulness when he assaulted her.

He said such involuntary sleep activity, known as REM behaviour disorder, usually lasts a few minutes, not the 90 minutes Yuen assaulted, raped and confined the woman.

"I have not read about or seen a parasomnia that has lasted that long," Hanly said.

He also said Yuen's dealings with the woman, which included wiping her blood off his walls and talking to the victim, was inconsistent with someone in a sleeping state or coming out of one.

"She describes ... that in the conversation (after the assault) he would drop his eyes from her bloodied head, presumably because it was disturbing to see that," Hanly said.

"Concealing what happened is not consistent (with parasomnia)."

Yuen faces four charges including aggravated assault and unlawful confinement for the attack in his home.

Defence counsel Balfour Der will cross-examine the doctor this morning.

I'm pretty embarrassed the doctor that testified for the defense, saying he 'may' have a sleep disorder, is from Ontario.

On a website site called 'ratemds.com' this pysch doc has many bad/poor reviews.  There are a few good notes, so I have to wonder who wrote those.  Imo, he sold his credentials for a large amount of money and some newspaper time.  The freakin' guy is allowed to teach in Ontario.

My apologies to Alberta that we could lend such nonsense to your judicial process.

Thanks for that info Woodland; it's good to know that. Perhaps the Ontario sleep specialist was a friend of Yuen's lawyer and owed him a "favor". No need for you to be embarressed. ;)

Balfour Der seems to be the "go-to" guy to get yourself "Off"...if you happen to be an "uber" (should have two dots over the U) a$$hole...and have landed yourself in a big pile of the brown-and-squishy stuff...hell he defended Colin Jones...the dude who ordered himself a pizza (in Calgary) after he caused a hit-n-run accident...then a few days later boogied back to Gatwick Airport...in England

I figure that the above a$$hole, the super bad trick...Yuen...never intended for the lady-of-the-evening to keep the $1000...he meant to kill her...which is what Gary Ridgeway used to do...

Am to understand that this silly broad...& I use the term with much knowledge-aforethought...went back to Yuen's home...after he was already into her credit-crunch for THOUSANDS OF DOLLARS????  No lady-of-the-evening worthy of the the term (and hell, there've been many a gal who parlayed their profession into a successful business)...would grant a trick this kind of credit...it's where the trick starts thinking of the lady as his "girl-friend"...& boy, is that a "NO-NO"
Cardinal sin...in the biz...all my sympathies, empathy, warm & cozies just went flying out the window for this woman!!!!

Flew in from VANCOUVER????  Everything about this case/event is so OUT THERE...tragi/comedy...from Yuen to his high-priced call-girl (in his mind "girl-friend") ..to his high-priced lawyer...to HIS high-priced defence witness...some hack head-doctor with a REALLY novel defence...cheesy & horrible...for everybody...
If Yuen was so broke...how could he afford this particular lawyer??
Sure doesn't sound like Julia Roberts in "Pretty Woman", does it?

Carol-Lynn...some of the material that falls outta the bottom of your pen/computer really startles the heck out of me...if any of my confreres...co-workers...of back in the day were to read your post...they would be suitably horrified...then laugh their guts out...far from being a bad "date"...I've got the scars to prove what a bad "date" can & will do...if given the opportunity...only back in the day we didn't call them "dates"...they were TRICKS...MARKS...Period!!!  The lady in this story broke some cardinal rules in dealing with this Yuen...first & foremost...a "business girl" NEVER would give a Mark credit...especially if he already OWED  her dough...it just wouldn't be good business sense...regardless of whether she was an independant or had a pimp...& if she had a pimp...& came all the way back to Vancouver...with empty jeans...he'd have probably beat the crap out of her anyway... 

Stupidity & a terminal lack of common-sense almost got this gal killed...she seems to have got the idea that the gravy train wasn't ever going to end...

I read some of the notes about the shrink that Balfour Dur used in Yuen's defence...Holy Mackeral...how is it that this goof is still practising medicine???

Whatever the rules are for escorts, surely there's no rule that one cannot "fall in love"? Perhaps the lady fell in love with Yuen? Why else would she fly across 2 provinces to be with him? She may not have realized what a SOB he is.
Has she herself said she was an escort? I don't think so, so maybe that is something he conjured up to spoil her image for the courts?

This is in reply to your nasty full-of-kukka post to me personally...which, incidentally I've reported to the moderator...Chris, I believe is his name...Nothin' fraudulent 'bout me...& the name you attempted to call me...in today's parlance would be "wannabe" not "want-to-be"...which I sure's hell am not...HAVE, however, lived through some bad-assed $$it that you probably only would have nightmares about...I sense that you're relatively New to the game...& still maybe believe in the "Pretty Woman" syndrome...you know...like falling in love with a "Trick", which is the oldest John-ploy in the book.  It's also one that a lot of well-meaning but naive square-johns...both male & female subscribe to...

SAP...you bring up an excellent point...the scuzz-bag fella Yuen certainly could have made that sort of comment re: the lady that he'd beat the crap out-of...again, it's an old ploy on the part of john "well, you know she gave me a freebe"...or "she's my girlfriend now, I shouldn't have to pay for it anymore"...or "she's just a hooker out for my money, I can do what I want with her"...a sense of entitlement...or of control over the lady...& Yuen sounds like a piece-of-work...something out of the freakin' dark ages...also like some line had been crossed...in his mind anyway...
