The Crown tried to appeal the acquittal but there's no further info what happened with that.

A Crown appeal was heard Wednesday in the case of a man acquitted of raping and killing a female Edmonton cabby in a high-profile cold case from 31 years ago.

On June 4, Robert James Fletcher, 52, was found not guilty of first-degree murder, rape, robbery, kidnapping and possession of a dangerous weapon in the Dec. 4, 1981, sex-slaying of Gerdina Kruidbos, 33.

On Wednesday, Crown prosecutor Susan Hughson argued a new trial should be ordered because the trial judge was wrong to exclude similar fact evidence.

Defence lawyer Daryl Royer argued there was no mistake made in the decision to exclude the similar fact evidence.

The panel reserved its decision in the appeal.
