Alberta's highest court says Aset Magomadova must again stand trial for strangling her teenaged daughter.

In a judgment released Thursday, Alberta's Court of Appeal decided a lower court judge erred in saying Magomadova was too ill to face a new trial for murder.

The Calgary woman was convicted in 2010 of manslaughter for killing her troubled daughter in 2007.


She received a suspended sentence and was put on probation.


That decision was appealed and another trial was ordered on the charge of second-degree murder.


But Magomadova has cervical cancer and her lawyer successfully argued in 2013 for a stay of proceedings, convincing the court she was too ill to go to trial again.


That stay has now been lifted.
No new trial date has been set.

Aset Magomadova, who was to face a new murder trial for strangling her troubled daughter in 2007, died in a Calgary hospice Wednesday morning of cervical cancer, according to her lawyer.

The Calgary woman was convicted of manslaughter five years ago for killing her 14-year-old daughter Aminat.

She received a suspended sentence and was put on probation.

That decision was appealed and another trial was ordered on the charge of second-degree murder.

But Magomadova's lawyer successfully argued in 2013 for a stay of proceedings, convincing the court she was too ill to go to trial again.

The stay was lifted in January, paving the way for a new trial.

How sad all the way around for this family. Having lived in a war zone and then finally got out to live in peace in another country and then more problems. Her daughter was failed by many who should have been able to help her and then dies at the hand of someone who had no resources left to help her, who snapped finally. The son has muscular dystrophy. Who will be left to care for him? The aunt? Care of these individuals is not easy either. Did they all have Canadian citizenship status? If not, will he be sent back? So so sad.
