Burnt Church man charged with sexual assault, confinement

A 29-year-old Burnt Church, N.B., man is facing four charges in connection to a sexual assault that allegedly took place on Sunday.

Curtis Bonnell is facing four charges, including sexual assault, unlawful confinement and resisting arrest.

The female victim has been identified only as MAWS.

When Bonnell walked into Miramichi provincial court on Tuesday morning, he immediately sat down, hunched over and covered his face.

Bonnell told Judge Geri Mahoney that he wasn't feeling well enough to stand up.

After the four charges against him were read in court, Bonnell was advised to consult with a lawyer before his bail hearing, scheduled for Friday.

He became upset and demanded that he skip the bail hearing and go on to the next legal step. He went on to swear at the judge and told Mahoney that he didn't care if he forced him out of the courtroom.

The judge removed him from court for the outburst.

He will remain in custody until the bail hearing.

Bonnell is the cousin of Hilary Bonnell, a teenager who went missing two months ago from the Esgenoopetitj First Nation, which is commonly known as Burnt Church.

The RCMP had officers and forensic investigators working Monday at the house on the First Nation where the alleged sexual assault occurred. Police were at the same house as part of a criminal investigation last week.

Police would not comment on the nature of the earlier investigation or on evidence seized at the house. Nor would they connect the search to the disappearance of Hilary Bonnell.

ESGENOOPETITJ - Just days after RCMP wrapped up a major search of an Esgenoopetitj First Nation home located just steps away from where missing teenager Hilary Bonnell was last seen, police returned to the home on Sunday to make an arrest in an unrelated case.

District 8 RCMP Insp. Roch Fortin said yesterday that police arrested a 29-year-old man at the Route 11 property Sunday evening after receiving a complaint from a 17-year-old girl at about 6 a.m. relating to a sexual assault.

Police are not releasing the man's identity at this time.

The brown bungalow where the arrest was made was confirmed last week by several sources, including Hilary's mother Pamela Fillier, her husband Fred Fillier and family friend Denise Parker, as belonging to Christopher Bonnell, Hilary's uncle and a band councillor.

The Burnt Church house was one of two searched by RCMP last week for evidence pertaining to an unnamed criminal investigation.

Fortin said the 29-year-old is being held in Tracadie-Sheila while he awaits a court appearance. The RCMP said last night he will appear in Miramichi provincial court this morning. He said the arrest is solely linked to the alleged sexual assault reported Sunday and not to the Hilary Bonnell investigation.

Meanwhile, Fortin said police completed their search of the sprawling Tabusintac property, also belonging to Christopher Bonnell, located on the Cains Point Road on Saturday, as well as other searches of undisclosed properties in the Burnt Church and Neguac area.

He said that while RCMP aren't able to disclose whether the search of the properties belonging to Christopher Bonnell were in any way tied to the missing teen, he said that the follow-up searches of separate properties in the area, including two additional properties yesterday, were indeed linked to Hilary.

"We were looking with a dog handler looking for possible evidence linked with the Hilary Bonnell case, but I cannot give you any more information than that," he said.

"I cannot link the two properties we did with a search warrant (to Hilary) because no one has been arrested or charged, but the other properties are directly related to the Hilary Bonnell case."

Addressing the media yesterday in the parking lot of the 4D's convenience store where her daughter was last seen on surveillance camera over two months ago and clutching a portrait of a newborn Hilary, Fillier vowed to continue her own personal search for Hilary, pointing out that she'll be going wherever she needs to go until she has a reason to stop.

The only day she'd ever stop fighting for her daughter, she said, would be the day she finally comes home.

"We need to stand up and protect our children, our babies, and if we don't then who will?" she added, tears streaming down her exhausted face.

Fillier issued another plea to the public to come forward to police with any information they may have.

Anybody with information pertaining to the missing teen can report it anonymously to New Brunswick Crime Stoppers at 1-800-222-8477 (TIPS).

A combined reward of close to $18,000 is being offered by the band and Crime Stoppers for information leading to Hilary's safe return.

Obviously there was reason to believe that Hilary disappeared right at the last place she was last seen. With this man having such a stack  of four different sexual assaults, it sure puts the light on him in this case. Of course, the police are investigating and as you say Solvy, this is a strange case. But now the police have some leads, maybe the case will be solved. Hopefully, soon there will be answers on the disappearance of Hilary. :'( :'( :'( :'( :'( :'(

The Missing Hilary Bonnell Facebook page is now changed to HILARY BONNELL and there are many messages of condolences to the family.  Very sad.
There is a new conference at 4pm today by the New Brunswick RCMP.  I'm on CST time, so I don't know what time that is here. 

Another sad day!  May the creator watch over her and her family & trust that the creator was immediately with her while she endured the pain that may have been inflicted upon her.

Bonnell, 16, was last seen on Sept. 5 walking along Highway 11 in Esgenoopetitj, commonly known as Burnt Church.

The RCMP searched properties in Burnt Church and another in the nearby community of Tabusintac last week that were connected to a criminal investigation. At the time, the RCMP did not link that search to Bonnell's disappearance.

 Curtis Bonnell will be in court,Friday November 13. 2009 at 9am at the Miramichi Provincial court! I've heard nothing since except as raisinpie mentioned an update by RCMP at 4:00 PM.

My prayers are with the family of Hilary, especially with her mother Pam.

Hilary Bonnell disappeared two months ago from her northern New Brunswick community. (RCMP)RCMP have discovered a body in an wooded area in northern New Brunswick and believe it may be that of Hilary Bonnell, the Esgenoopetitj First Nation teenager who went missing two months ago from the northern New Brunswick community.

RCMP Insp. Roch Fortin told reporters that police had been searching in the former military firing range in Tracadie-Sheila, which is where they found the body.

The remains have been sent for additional testing and identification. However, RCMP said Bonnell is the only person reported missing in the area.

Police said foul play is suspected, and they have a suspect.

The suspect is in police custody.

Bonnell, 16, was last seen on Sept. 5 walking along Highway 11 in Esgenoopetitj, commonly known as Burnt Church.

The headlines news has indicated that Hilary Bonnell's body was found in a wooded area where she went missing. A sad ending for Hilary. My sympathy goes out to her mom, friends and family members. Thanks to the police who have done an extensive search to find Hilary. Trusting the evidence will convict the person who took Hilary's life. :'( :'( :'( :'( :'(
