Curiouser and Curiouser. Let us hope the Police have the right person and enough evidence to back up this arrest. As a tax payer I don't want to foot another oops when down the line he walks out the back door of a prison straight through the front door of his lawyer.

OSHAWA -- The man charged in the 1974 murder of Beverly Smith made a brief appearance in Oshawa court Monday, looking haggard, and staring out into the gallery, shaking his head.

Alan Smith, a former neighbour of, but no relation to Beverly Smith, was arrested for the second time earlier this month, this time charged with first degree murder in the woman's death.

He had been charged in 2008 with second degree murder, but the charges were later dropped, with the Crown Attorney on the case citing no reasonable prospect of conviction.

He appeared Monday, wearing loose-fitting jeans and a brown button-up hoodie. He looked out into the courtroom several times to the area where Ms. Smith's twin sister was seated, and shook his head back and forth.

Ms. Smith was found dead in her Raglan home in 1974, her 10-month-old daughter sleeping nearby. She had been killed by a single gunshot to the back of the head.

No arrest was made. But in February 2008 Durham police resurrected the cold case, holding a press conference with Ms. Smith's daughter and sister pleading for information in the case.

Just over a month after the press conference, police arrested Mr. Smith, a Cobourg resident, charging him with second degree murder.

Despite the very public displays both when pleading for information and when an arrest was made in 2008, this time around, Durham police have been almost entirely mum on the issue. A very brief media release indicating the re-arrest had occurred was not issued until after Mr. Smith had already made his first court appearance. It indicated police would be making no further comment.

Durham Police Chief Mike Ewles stands by that stance.

"That's a classic example of a very, very complex case that we've committed a lot of time and energy to," he said Friday. "We've worked very, very hard on it and we've had some bumps in the road . . . we're going to have to let that case run its course throughout the system, so I'm not going to give any more evidence, I'm not going to give any more disclosures on that piece.

"But rest assured we're working very, very closely with our partners in the justice system to make sure that we get a resolution once and for all."

Mr. Smith is to return to court Jan. 5.

The link below leads to a very lengthy but interesting article from the Toronto Star regarding this crime, it's impacts on Beverlys' family and the man charged for this murder, as well as a peek into police and RCMP investigations.  The confessions obtained from the accused were through a Mr Big operation and resulted in an acquittal after the Crown in July 2014 conceded that there is no reasonable prospect of conviction after the Ontario Supreme Court disallowed the 'confessions'.

1974: Beverly Smith is shot once in the back of her head in Raglan, near Oshawa. Her 10-month old baby, Rebecca, is found in the other next room.

1974-197519861988: Police arrest Doug Daigle. According to police documents, Daigle was a drug dealer, and police had gotten a tip that he killed Beverly. He was put in jail with an undercover cop, but did not confess to the murder and was released.

2007February 2008: Police re-interview neighbour Linda Smith, who said that on the night of the murder, her then husband, Alan Smith, had left the house for about an hour. She said she heard a loud bang, then saw him putting a gun in his car.

March 2008: Alan Smith is arrested and charged for the second-degree murder of Beverly Smith.

July 2008: Alan Smith is released from jail after the Crown drops the charge. The case against him had unraveled after his wife recanted her incriminating statement and, at one point, claimed to have killed Beverly herself.

February 2009July 2009: Alan Smith gives the first of two confessions to the murder, saying he killed Beverly Smith with another man to steal marijuana in the house.

November 2009: Alan Smith gives a second confession, saying he alone killed Beverly Smith to stop her from talking about an affair he was having.

December 2009: Alan Smith is arrested for first degree murder.

June 2014July 2014: Alan Smith is acquitted after the Crown concedes there is no reasonable prospect of conviction.
